Terms of Service
The terms that apply to this website and to work carried out by Wimberley Tree Service LLC.
Who these terms are with
This site is operated by Wimberley Tree Service LLC, based in Wimberley, Texas. Using the site, or requesting an estimate through it, means you accept these terms. If you do not accept them, please do not use the site.
What the site is, and is not
The pages here describe the work we do and offer general guidance about trees in the Texas Hill Country. That guidance is written carefully, but it is general information, not a professional assessment of your particular tree. No article on this site is a substitute for someone standing at the base of the tree and looking at it. Do not rely on anything here to decide whether a specific tree is safe.
Nothing on this site is a binding offer to perform work. A contract exists only once we have provided a written estimate for your property and you have accepted it.
Estimates and pricing
Estimates are free and carry no obligation. An estimate is based on what was visible and accessible when we looked at the site. The price we quote holds for the work described in it.
Conditions that could not reasonably have been seen at the time of the estimate may change the scope. Internal decay, a hidden utility line, a structure inside the drop zone or ground that will not carry equipment are the usual examples. Where that happens we will stop, explain it, and agree any change with you in writing before continuing. We do not add charges after the fact.
Estimates are valid for 30 days unless stated otherwise on the estimate itself.
Scheduling, weather and cancellation
Tree work is weather dependent and safety dependent. We may reschedule for high wind, lightning, saturated ground or any other condition that makes the work unsafe. We will tell you as early as we can when that happens.
Emergency work may take priority over scheduled work. If a tree comes down on a house, we fit it in as soon as the crew can get there, and other jobs may move. We appreciate your patience when it is someone else, and you get the same priority when it is you.
Please give us as much notice as you can if you need to cancel or reschedule.
Access to the property, and what we need from you
You confirm that you own the property or are authorized to instruct work on it, and that you have any consent needed from a co-owner, landlord, HOA or neighbor whose property is affected.
Please tell us before work starts about anything underground or hidden that we could damage: septic systems and drain fields, irrigation lines, private water and gas lines, invisible fencing, buried electrical runs and the like. Public utilities are locatable; private lines usually are not, and we cannot be responsible for damage to unmarked private services we were not told about.
Please also move vehicles, keep children and animals well clear of the work area, and unlock gates that we will need.
Permits and local rules
Permitting requirements for tree removal vary by jurisdiction, tree size and species, and are stricter inside city limits than on unincorporated land. Where we think a permit or an HOA approval is likely, we will say so. Obtaining it remains the property owner’s responsibility, and we will not begin permitted work until it is in place.
Insurance and liability
We carry $1,000,000 general liability insurance ($2,000,000 aggregate) through American Builders Insurance Company, and we will send the certificate before we start. It is worth asking anyone you call what theirs actually covers rather than assuming. We take care, and we plan removals before a saw starts, but tree work carries inherent risk that no amount of care removes entirely.
We are responsible for damage caused by our own negligence. We are not responsible for: pre-existing damage; damage to unmarked private underground services; lawn, drive or hardscape marking that is a normal consequence of getting equipment to the work; or consequential losses such as lost income or loss of use. Except where the law does not permit it, our total liability for any claim is limited to the amount you paid for the work in question.
Payment
Payment is due on completion unless the estimate says otherwise. Larger jobs may require a deposit, which will be stated on the estimate before you accept it. We will tell you which payment methods we take when we quote.
Photographs of the work
We often photograph jobs and may use those photographs on this site or on our Business Profile. Photographs show trees and the work, never identifying details of a property or its occupants, and we will not use a street address alongside them. Tell us if you would rather we did not photograph your job and we will not.
